On Wednesday, March 22, troopers on patrol on the Sprain Brook Parkway in Greenburgh conducted a traffic stop after they spotted a black Mercedes failing to maintain its designated level of travel.

During the subsequent traffic stop, police said that they observed the passenger of the vehicle, 34-year-old William Allen, pass several bags of marijuana to the driver, Derrick Sutton, 30. Troopers then reported that they saw Sutton pushing the bags between the center console and driver’s seat in an attempt to hide them.

According to police, from the passenger side window, the trooper asked Sutton to hand him the marijuana he had seen, and while moving from the passenger side to the driver’s side, Sutton allegedly threw the marijuana from the window and fled, almost striking the trooper. Allen, who had been out of the vehicle and was being interviewed, fled on foot.

Police said that the trooper pursued Sutton northbound, where he attempted to exit the parkway onto Dobbs Ferry Road, when he lost control and struck a cement barrier before also fleeing on foot. With an assist from officers in Greenburgh, Sutton was eventually located on the southbound ramp of the Sprain Brook Parkway and placed into custody. Allen would later be apprehended on Secor Road.

Allen was charged with a felony count of violating probation and resisting arrest, a misdemeanor. He was also charged with a violation for unlawful possession of marijuana.

Troopers observed clues that Sutton was impaired, police said. He was evaluated by the arresting officer and a State Police Drug Recognition Expert, who both determined he was impaired and unable to operate a motor vehicle.

Sutton was charged with felony counts of reckless endangerment, tampering with physical evidence and first-degree aggravated unlicensed operation of a vehicle, when it was discovered that his license had been revoked for having 31 suspensions on 25 different dates. He was also charged with resisting arrest, unlawful fleeing a police officer in a motor vehicle and operating a motor vehicle while impaired by drugs, all misdemeanors. Sutton was also levied a violation for unlawful possession of marijuana.

Both Sutton and Allen were arraigned in the Town of Greenburgh Court. Sutton was remanded to the Westchester County Jail without bail, and Allen posted $1,500 cash bail and was released. Both are due back in court on Tuesday, March 28.
