Judge Rules White Plains Wrongful Death Case Can Proceed

WHITE PLAINS, N.Y. -- A federal judge ruled on Tuesday, Dec. 10, that a $21 million wrongful death law suit filed by the family of Kenneth Chamberlain, Sr. could proceed, according to LoHud.com.

Chamberlain was shot and killed by White Plains police who were responding to a call from Chamberlain's medical alert device in November of 2011. When Chamberlain refused to allow police into his home, they broke down the door. Police allege Chamberlain attempted to attack one of the officers with a knife, LoHud.com reported. 

The city had filed a motion to have the case dismissed after a grand jury decided not to bring criminal charges against any of the officers involved, according to LoHud.com.
