Taqiy Walton, 35, pleaded guilty to felony assault, attempted assault and criminal possession of a weapon, in the shooting of Peter Schmidt Sr., said McCarty.
The shooting occurred on July 13, 2015, after Schmidt, who was mowing his lawn at the time, noticed a car in the driveway of a home across the street which he knew was vacant at 5 Payne Road in Elmsford.
Schmidt, along with his son, a current Greenburgh police officer, went to investigate. That's when two men, Walton and Adam R. Larregue, 20, also of Elmsford, came out of the house. As Schmidt and his son began questioning the duo they became belligerent, McCarty said.
Walton fired a semi-automatic pistol towards the men as they turned to leave the area, striking Schmidt twice, once in the torso and once in the arm. Walton and Larregue than jumped in the car and drove away, McCarty said.
As they were leaving, Schmidt's son was able to take down the license plate of the vehicle and an extensive pursuit took place involving several police departments.
Walton and Larregue were nabbed by Yonkers police on the Sprain Brook Parkway in Yonkers. The next day, a K-9 from the New York State Police located the pistol not far from where the defendants were arrested.
Larregue pleaded guilty to felony burglary earlier this year. Walton faces a maximum of 25 years in prison. His sentencing will take place on Jan. 11, 2017.
Assistant District Attorney Julia Cornachio of the Superior Court Trial Division is prosecuting the case.
