White Plains Seeks To Toss $21M Lawsuit In 2011 Police Shooting

WHITE PLAINS, N.Y. -- Legal wrangling continues in the $21 million wrongful death lawsuit against White Plains by the family of a man shot by police in 2011 now that city lawyers this week asked a federal judge to throw out the case, according to lohud.com.

Kenneth Chamberlain Sr.'s family filed a $21 million wrongful death lawsuit after a Westchester County grand jury opted not to indict police officers involved in the Nov. 19, 2011, incident in which Chamberlain was shot to death.

Lawyers for the family of Kenneth Chamberlain Sr., meanwhile, filed responses to the motions claiming there is more than enough evidence that the case should go to trial. White Plains officials said the lawsuit does not contain evidence to show a lack of training, negligence or excessive force or other complaints caused the shooting death, reports lohud.com.

The lawsuit was filed after a Westchester County grand jury declined to indict any of the officers in the Nov. 19, 2011, incident at Chamberlain's apartment. Police said he was threatening them with a knife, while his family says he repeatedly told police he didn't need their help, says lohud.com.
