WHITE PLAINS, N.Y. -- A Mount Vernon man was sentenced to nine years in state prison for assaulting someone with a garbage can at the White Plains Metro-North Train Station, Westchester County District Attorney Janet DiFiore announced Thursday.
Robert France, 51, was charged with first-degree assault, a class "B" violent felony, and second-degree assault, a class "D" violent felony, in connection with the April 12, 2011 incident.
About 2:50 a.m. that morning, France confronted the victim, whom he believed had his cell phone. After exchanging words, the defendant hit him repeatedly, then began using a large metal garbage can on him, breaking the victims leg. The victim was taken to White Plains Hospital, then transferred to Westchester Medical Center because of the severity of his injuries, which required seven screws in his lower leg and multiple stitches in his left hand. He also had multiple facial fractures.
France was arrested by MTA police and convicted in March by a jury trial. Assistant District Attorney Alexis Celestin of the Superior Court Trial Division prosecuted the case.
