WHITE PLAINS, N.Y. -- A lawyer for the family of a White Plains man killed by police in 2011 says Kenneth Chamberlain Sr. was lying on the floor at the time of the shooting, according to a report on LoHud.com.
Attorney Debra Cohen argued in federal court that a jury should rule on whether police were justified in shooting Chamberlain, 68, while he was injured and lying on the floor, LoHud.com reported.
The Chamberlain family filed a $21 million lawsuit against White Plains after a grand jury failed to indict the officers involved, according to LoHud.com.
